IGBAJO OBASHIP TUZZLE - Enforcement Of Rights' Suit: Oba Famodun Wins Round One As Court Grants Interim Injunction






The Federal High Court sitting in Osogbo has reserved judgment in a Fundamental Enforcement Suit No. FHC/OS/CS/2024 between HRM Oba Adegboyega Famodun V. Inspector-General of Police & 10 Ors filed by His Royal Majesty, Oba Adegboyega Famodun, to restrain the Osun State government from using the police, DSS and all other law enforcement agencies from harassing, arresting and or banishing him from Igbajo.



Recall that Osun State Government recently claimed to have deposed HRM, Oba Adegboyega Famodun as Owa of Igbajo while matter in respect of his installation is still pending in court and the state government is a party to the pending suit.


The event took another turn when the police began to unnecessarily invite him and the basis upon which the monarch approached the court for enforcement of his fundamental rights. 


The matter  commenced yesterday 13th March, 2024 and was adjourned to today 14th March, 2024 for definite hearing resulting from the excuse by the government's counsel praying for an adjournment. 


Upon adoption of the parties' respective cases today, counsel to the Applicant applied that the parties be ordered to maintain status quo pending the final determination of the suit. 


The Applicant's counsel further informed the court that the main chieftaincy issues involved have been submitted for court determination at the State High Court which just resumed last Monday. 


In his ruling, Hon. Justice Manshur Salisu adjourned the matter to  29th April, 2024 for final judgment and granted order as prayed by the Applicant's Counsel that parties should maintain status quo.
