A Federal High Court (FHC) in Abuja, presided over by Hon. Justice Nwite, has struck out a suit filed by the Attorney General of Osun State seeking to restrain the Central Bank of Nigeria (CBN) and the Accountant General of the Federation from paying statutory allocations due to Local Government Areas (LGAs) in Osun State to an account operated by APC-elected chairmen and councillors.
The decision followed a Notice of Discontinuance filed by the plaintiff, prompting the court to strike out the suit. The court also expunged an affidavit of facts and grounds for the discontinuance from its records, describing them as being brought in bad faith and an attempt to introduce damaging facts without giving defendants an opportunity to respond.
The suit has been struck out, paving the way for the CBN and AGF to release the statutory allocations to the LGAs in Osun State.
