In a decisive 6‑to‑1 ruling, Nigeria’s Supreme Court has dismissed the lawsuit filed by the Attorney‑General of Osun State seeking the release of statutory allocations to the state’s 30 local government councils. The apex court ruled that there is *no legal dispute between Osun State and the Federal Government* that would give the state’s AG the right to invoke the Court’s original jurisdiction.
Justice Mohammed Idris, who delivered the majority judgment, said the proper plaintiffs are the local government areas themselves, not the state attorney‑general. “The Attorney‑General of Osun lacks locus standi to institute this action,” the Court held, adding that the case is incompetent and is hereby struck out.
The judgment reaffirmed the constitutional principle that the three tiers of government – Federal, State and Local – are autonomous and independent. Consequently, Local Government Areas have exclusive control over their funds and must receive statutory allocations directly from the Federation Account, without interference from state governments.
The Court further ordered the Federal Government to remit all local‑government allocations to every LGA across the country and warned that failure to comply would amount to disobedience to the rule of law.
Only one of the seven‑member panel dissented.
The decision comes amid a broader national debate over local‑government autonomy, following the landmark July 2024 Supreme Court judgment that mandated direct payment of allocations to the 774 LGAs.
