The Osun State chapter of the All Progressives Congress (APC) has alerted the Inspector-General of Police and the Nigerian Security Agency(NSA) of the plans of the state government to plunge the state into an avoidable crisis through the deliberate twisting of the Friday judgement of the Supreme Court on the logjam of the local government allocations which was struck out by the apex court.
It would be recalled that several political functionaries including the embattled partyless Governor Ademola Adeleke, the state chairman of the decimated Peoples Democratic Party(PDP), Mr. Sunday Bisi, the state Commissioner for Information and Enlightenment, Mr. Kolapo Alimi and others have been taking turns to misinform the public by twisting the Supreme Court judgement which struck out the case instituted by the State Attorney-General against the Attorney-General of the Federation.
It is important to inform the Inspector-General of Police and the NSA that the leadership of the PDP working in cahoot with the state government have perfected coordinated plans to be attacking the members of our party across the local government council areas in the state.
In order to test the water of their violent attacks, no fewer than five members of our party at Otan-Aiyegbaju in Boluwaduro Local Government Council Area of the state were attacked and grievously wounded by the PDP thugs led by one Felix Falola alias 'Agba' shortly after the delivery of the Supreme Court judgement that struck out the Osun State Attorney-General's case for being incompetent and lack of jurisdiction.
It was however, surprising that the state commissioner for information who is a lawyer was busy twisting the Supreme Court judgement thereby misinforming the people and inciting unrest and violence through a radio programme monitored in Osogbo, the state capital, today.
It is important for the misinformed members of the public to note that on Friday, the 5th Day of December, 2025, the Supreme Court of Nigeria gave judgement in the case of Attorney-General of Osun State v. Attorney-General of the Federation in the suit number SC/CV/379/2025.
The ratio or points of the judgement are as follows: Local Government Statutory allocations are to be paid directly to the Local Government Councils.
Each tier of government: federal, state, and local, is independent of any other and completely autonomous.
Local Governments have exclusive power over their funds without any interference from the State or Federal Government.
The Attorney-General of Osun State lacks the locus standi, or the right to bring the case before the Supreme Court. The Supreme Court's original jurisdiction is any dispute between the Federal and State Government.There is no dispute between the Federal Government and the Osun State Government.
The Local Governments are legal personalities who have the power to sue and be sued. They are the ones who have the locus, to sue on their own funds, not the Attorney-General of Osun State.
The right court to go is the Federal High Court and NOT the Supreme Court.
The case that was brought by the Attorney-General of Osun State against the Federal Government was therefore, declared incompetent and was struck out.
That was the judgement of the Supreme Court while the lead judgement was read by Justice Muhammed Idris and was promptly backed by six Justices of the Supreme Court and one Justice Emmanuel Agim, disagreed with majority decision.
The question that is agitating the right-thinking members of the society is how can a person's case be declared incompetent and struck out, and the person be claiming victory?
A court declared that a person had no right to have brought a case in the first place, and the person is claiming victory in it? What kind of "victory" is that?
Is there anywhere in the case where the Supreme Court mentioned 'the PDP sit-at-home chairmen and councilors'? The claim of 'victory' by Governor Adeleke and his cohorts is not only ridiculous, it is a contempt of court.
We, as a party, are cautioning Governor Adeleke, a supposed chief security officer of Osun State, to desist from any actions and inactions capable of disturbing the public peace in any part of the state.
We are imploring our members and supporters to continue to imbibe the principles of the rule of law which have carried us this far in our political journey to instil sanity into the local government administration in the state.
We are not unaware of the fact that Governor Adeleke and his wandering political co-travellers are needlessly engaging in stratagem as tactics to keep their gullible followers' hope such that the imminent implosion in their political camp will not happen earlier than expected.
