Legal Showdown: Accord Party Split Over Osun Primary and Leadership






A faction of the Accord Party has taken the party’s internal dispute to the High Court of the Federal Capital Territory (FCT) in Abuja. On 3 December 2025, Oliver Bitrus filed suit FCT/CV/4955/2025 against the Accord Party, National Chairman Maxwell Mgbudem and the Independent National Electoral Commission (INEC).


Bitrus, through his lawyer  Daniel Edeachi, argues that Mgbudem and his deputy  Chief Okey Nwosu were lawfully suspended by the faction for alleged anti‑party activities and that the faction subsequently appointed  Prof. Chris Imumolen as the party’s national leader, relying on a Federal High Court judgment they say validates that appointment.


The suit asks the court to:


- Nullify all statutory notices issued in the party’s name, including the notice of ward congress and the Osun governorship primary.


- Void any acceptance or publication of candidates submitted to INEC by Mgbudem or anyone other than Bitrus, who claims to be the lawful acting National Chairman.


- Grant a perpetual injunction restraining Mgbudem from acting as National Chairman while disciplinary proceedings are pending.


- Bar INEC from recognizing Mgbudem or any primaries he conducts.


Bitrus cites Section 223 of the 1999 Constitution, Sections 82 and 84 of the Electoral Act 2022, and relevant clauses of the Accord Party constitution to argue that a suspended chairman cannot issue notices, convene meetings or form committees. He also asks the court to rule on whether his nomination by the National Executive Committee on 29 November 2025 to serve as acting National Chairman is lawful pending the disciplinary outcome.


The court has not yet set a hearing date.
