Osun APC Rejects Court Ruling, Says Reinstated Chairmen Will Continue Duties Until Appeal Is Exhausted

The Osun State chapter of the All Progressives Congress (APC) has rejected the judgment of the Federal High Court sitting in Osogbo on the status of the reinstated local government chairmen and councillors elected in the October 15, 2022 local government elections.

In a statement issued on Monday by the party's Director of Media and Information, Mogaji Kola Olabisi, the APC described the judgment as a "miscarriage of justice" and announced its decision to challenge the ruling at the Court of Appeal.

The suit, marked FHC/OS/CS/147/2025, was instituted in September 2025 by the reinstated local government chairmen and councillors. According to the APC, several interlocutory appeals had arisen from the matter, with the Court of Appeal in Abuja hearing related applications on June 3, 2026, before adjourning further proceedings to September 28, 2026.

The party expressed concern that despite a pending motion seeking a stay of proceedings before the appellate court, the Federal High Court proceeded to deliver judgment on June 15, dismissing the suit.

In its ruling, the court reportedly held that the tenure of the reinstated local government officials expired in October 2025.

The APC, however, argued that the judgment raises questions about the validity of the local government elections conducted by the Osun State Independent Electoral Commission (OSSIEC) on February 22, 2025, as well as the swearing-in ceremony held the following day.

The party maintained that it would pursue all available legal remedies and insisted that the affected chairmen and councillors have already exercised their constitutional right of appeal by filing a notice of appeal and a motion for stay of execution.

According to the APC, no enforcement action should be taken against the officials pending the final determination of the appeal.

The party also urged its members and supporters to remain calm and law-abiding while awaiting the outcome of the appellate process.

Furthermore, the APC called on security agencies to maintain law and order and prevent any actions that could trigger unrest in the state over the development.

The statement concluded with an appeal to residents of Osun State to exercise restraint and allow the judicial process to run its course as the matter proceeds before the Court of Appeal.
